The technologies and practices in the domain of workplace monitoring can change quickly and to a significant extent. To ensure that the existing and any proposed legislation remains up to date and constitutes an effective and holistic regulatory response to the challenges posed by workplace monitoring, it is important to provide for empowerment clauses in the legislation proposed by this analysis but also in the frame of the existing labour legislation and, for example, in the upcoming legislative proposals on AI in Europe. These clauses will allow public bodies/governments to supplement and/or update the relevant criteria and methodologies on a regular basis.
