Outlines the European position and then covers the situation under UK law, showing the differences. Looks at the future proposed models of European Collective Agreements and highlights the need for discussion whilst the European Collective Agreement is in its infancy. Advocates different definitions for procedural and collective agreements with the former carrying legal enforceability which exists in Europe and the latter using the UK definitions and carrying legal unenforceability.
