Purpose

This paper aims to critically analyse India’s Mediation Act, 2023, assessing its potential to reshape the nation’s dispute resolution landscape by identifying its strengths and probing implementation challenges.

Design/methodology/approach

The study uses a mix of qualitative, doctrinal and comparative legal research methodologies. It examines the Act’s core pillars, including the enforceability of settlements, the Mediation Council of India and pre-litigation, community and online mediation. Recognising the absence of empirical data due to the recent implementation of the legislation, the study relies on comprehensive statutory interpretation and a functional comparative analysis with frameworks in Nigeria and Singapore. It also uses a normative analysis to examine the emerging legal frameworks such as the Digital Personal Data Protection Act, 2023 (DPDPA).

Findings

The Act’s primary strength is making mediated settlements enforceable as court decrees, with the Mediation Council being a crucial institutional step. However, its success is contingent upon effective implementation, robust rule-making, overcoming cultural resistance and developing mediator infrastructure. The paper also highlights new opportunities for professionals.

Research limitations/implications

While this analysis provides a comprehensive overview of the Mediation Act, 2023’s potential and challenges, it is inherently limited by its nature as an early-stage, non-empirical review; the actual impact of the legislation can only be assessed over time through longitudinal studies and data collection.

Originality/value

This analysis serves as a crucial roadmap for policymakers and the Mediation Council of India by highlighting critical implementation hurdles, while also offering legal and corporate professionals, such as Company Secretaries, strategic insights into new service opportunities and their evolving role in fostering a more efficient and collaborative dispute resolution ecosystem.
