This study aims to address issues caused by artificial intelligence (AI), the European Union (EU) passed directives and regulations to regulate digital infrastructure, data and content. One of the regulations is the Artificial Intelligence Act (AIA). It was adopted to support trustworthy AI. As AIA has extra-jurisdictional global implications, there is a trend to enact similar laws internationally. This initiative will enable the standardization of law at the international level and help in developing novel expertise in interpreting the rules and providing clear guidance. To regulate AI technology, Canada drafted the Artificial Intelligence and Data Act (AIDA) to align with AIA, imposing regulatory requirements on high-impact AI systems. This article analyzes the AIA and compares AIDA across various provisions, including oversight requirements, to propose an appropriate AI law.
The research used content analysis to assess the available literature and find the gap in the literature, doctrinal was used to investigate the laws and regulations on AI and the adequacy of the laws and the comparative research method was used to compare the AIA of the EU and the Canadian AIDA so that appropriate recommendations can be given to improve the draft AIDA or future AI-related laws and regulations in Canada.
The results revealed that the abrogated AIDA has many loopholes and any new AI-related law should address risk assessment, AI principles, oversight requirements and the roles and responsibilities of parties in detail.
